By accessing or using Mixmi ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. The Platform is operated under the registered trade name MIXMI ONLINE SHOP (DTI Certificate No. 7497503), with its registered business address at P73-A 9th 2nd St., Villamor, Pasay City, Metro Manila, 1300, Philippines, and reachable at support@mixmi.co ("Mixmi," "we," or "us").
Governing law and venue. These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law rules. Any dispute arising out of or relating to these Terms or your use of the Platform that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the proper courts of Pasay City, Metro Manila, Philippines, without prejudice to any mandatory consumer rights you may have to bring a claim before the appropriate Philippine government agency.
You set the price for each artwork you upload. The minimum set price is ₱100. There is no maximum. Each artwork's floor priceis 50% of its set price, this is the lowest amount that artwork will contribute to any sale's art pool. You can change your set price for future sales at any time. Pending orders are unaffected by price changes; the price snapshot at the time of order is what applies.
When a buyer purchases a product with only one artwork, you earn your full set price minus Mixmi's platform fee.
Platform fee:
The platform fee is calculated on the art pool only. Production cost, shipping, and payment processing are handled separately and are not deducted from your earnings.
When a buyer composes a product using two or more artworks, Mixmi's Mix & Save pricing engine applies. The engine adjusts the total art pool so buyers pay a fair price for compositional products instead of the sum of every individual set price, while protecting every artwork by its own floor (50% of its set price).
The Mix & Save engine works as follows:
The platform fee (25% or 20% depending on origin) is then applied to the adjusted art pool. Each artist pays a share of the fee proportional to their artwork's contribution to the pool. Each artist's earnings = (their artwork's contribution to the pool) − (their share of the platform fee).
Every artwork you upload is set to Open mode by default. You can switch any artwork to Own-only mode at any time from your artwork dashboard. Mode changes apply to future orders only.
When a buyer pays for an order, Mixmi records what we owe you as a commercial payable in your earnings ledger. Your earnings move through two states: Pending, while the order is being fulfilled, and Ready to Withdraw, once the order is fulfilled (for prepaid orders) or once we have collected the cash from our fulfillment partner (for cash-on-delivery orders). See §8 Earnings & Payouts for full mechanics.
Payment processing fees are absorbed by Mixmi and are never deducted from your earnings.
If a buyer is refunded or successfully chargebacks an order before the funds settle, the corresponding earnings are reversed in your wallet at no impact to amounts you've already withdrawn. If the funds were already withdrawn before the chargeback, Mixmi may recover the amount from future earnings. We will always notify you before any reversal.
Every Mixmi product is printed to order for a specific buyer, so we do not offer change-of-mind returns. What we do cover is our own side of the job: if an order arrives wrong, damaged, or not at all, we replace or refund it. Orders are fulfilled by our vetted third-party print fulfillment partner. Estimated production time is 3-5 business days, plus shipping. Details of our current fulfillment partner are available upon request at support@mixmi.co.
Our fulfillment partner coordinates proof-of-delivery (POD) photography with the courier at the point of handoff. Buyers are strongly encouraged to photograph or video the unopened package upon delivery before opening. Claims supported by unboxing documentation will be processed faster and with greater accuracy. Mixmi reserves the right to request POD records from the fulfillment partner or courier as part of any refund investigation.
Claims must be filed within 7 calendar days of delivery. This is a deadline on reporting the problem, not on resolving it: once a claim is filed in time, the investigation below runs its full course. Where a delivery date was never recorded, the window is counted from the shipping date instead and extended to allow for transit, so a missing delivery confirmation never costs the buyer their window. If the deadline has passed and you believe the circumstances warrant it, email support@mixmi.co.
Claims are filed from the order itself, so the evidence stays attached to the order record. Open your orders, open the affected order, and choose Report a problem. You will be asked to:
A claim can be filed once an order has been fulfilled, shipped, or delivered. Before fulfillment begins there is nothing to refund yet, so cancel the order instead. Only one open claim exists per order at a time, and its current status and promised response date are shown on the order page.
Buyers who checked out as a guest have no account order page, and should instead email support@mixmi.co with the order number and the same evidence. The rules in this policy apply identically either way.
An approved refund covers the purchase price of the specific item(s) confirmed as affected. Shipping fees and the Cash on Delivery surcharge are non-refundable and are not included in any refund amount. Refunds for online payments are returned to the original payment method; refunds for Cash on Delivery orders are sent to an e-wallet account (GCash or Maya) nominated by the buyer.
All refund and reprint requests are subject to a mandatory investigation period of 5-7 business days from the date the claim is submitted. During this period, Mixmi will verify the claim with the fulfillment partner and courier records before approving or denying the request. No refund or reprint will be issued prior to the conclusion of the investigation. Mixmi will notify the buyer of the outcome on or before the end of that period. Mixmi reserves the right to deny claims where evidence of intentional damage, fraud, or abuse is found.
Business days exclude Saturdays, Sundays, Philippine regular holidays, special non-working days, and any day on which work is officially suspended. A claim filed before a holiday period will therefore take longer to resolve in calendar terms than the number of business days suggests. The claim page in your Mixmi account always shows the date by which you will hear back.
Buyers agree to submit all refund or replacement requests through the claim process above before initiating any dispute, chargeback, or reversal with their bank, card issuer, or e-wallet provider. Filing a chargeback while a refund request is actively being processed by Mixmi is considered a violation of the Terms of Service and may result in permanent account suspension.
Refunds and reprints for confirmed fulfillment errors are absorbed by the Platform. Licensor earnings are not clawed back on fulfilled orders. If an order is cancelled before fulfillment begins, any pending wallet balance is reversed.
An order can be cancelled while it is still awaiting submission to production, usually within the first hour or two after checkout. Once the order is at the printer it cannot be cancelled, because every piece is custom-made. Cancelled orders are refunded in full, including shipping.
For anything this policy does not answer, contact us at support@mixmi.co or through the contact page. This policy forms part of the Terms of Service and is incorporated into them by reference.
This section is also published on its own as the Return & Refund Policy, which forms part of these Terms.
When a buyer pays for an artwork that includes your work, Mixmi records what we owe you as a commercial payable in your earnings ledger. Your earnings move through two states: Pending, while the order is being fulfilled, and Ready to Withdraw, once the order is fulfilled (for prepaid orders) or once we have collected the cash from our fulfillment partner (for cash-on-delivery orders). Ready-to-withdraw earnings can be cashed out at any time. There is no minimum.
Creator verification.Verified creator is an optional status. To become verified you must have at least 5 live artworks published and at least one social media handle linked on your profile, you must add your Mixmi profile link to that account so we can confirm it is yours, and your verification request must be approved by Mixmi. If you genuinely have no social media presence, you may ask Mixmi to waive the social handle requirement; the artwork requirement always applies. Verification does not affect your money: it is never required to sell, to earn, or to withdraw, and your balances accrue and remain withdrawable whether or not you are verified. What it unlocks is the verified badge on your profile, eligibility to earn referral rewards, and consideration for Mixmi's own promotional placements. Mixmi may withdraw verified status if the linked account is changed or the requirements are no longer met.
Pending earnings are not held as a deliberate buffer; they simply track orders that haven't shipped yet. Holding them in Pending until fulfillment protects you from chargebacks or refunds on orders that fail before they leave the warehouse, so that no amount is ever clawed back from your Ready-to-Withdraw balance.
Withdrawals are processed through PayMongo to your registered GCash or Maya account. A flat payout fee is deducted from each withdrawal to cover the disbursement cost charged by our payment partner; the exact amount is shown in the withdrawal confirmation before you submit. You initiate every withdrawal yourself. Your Ready-to-Withdraw balance stays in your earnings ledger until you request a payout, with no expiry and no obligation to cash out by any date. Mixmi does not disburse your balance on a schedule or on your behalf.
Tax withholding (Philippine licensors). As a withholding agent registered with the Philippine Bureau of Internal Revenue (BIR), Mixmi is required to withhold tax on your earnings before payout and to remit it to the BIR on your behalf. Two regimes apply, and which one covers you determines whether the tax is recoverable by you.
Final withholding tax on royalties. Because you license your artwork to Mixmi and Mixmi produces and sells the finished item as the seller of record, your earnings are royalties. A royalty paid to an individual is subject to a final withholding tax, normally 20%, under the National Internal Revenue Code. Final means the tax on that payout is settled in full: it is not declared on your annual income tax return, it is not credited against any other tax you owe, and it cannot be refunded to you, including where your total income for the year would otherwise fall below the taxable threshold. A sworn declaration does not reduce this rate. We certify the amounts withheld on BIR Form 2306.
Creditable expanded withholding tax. Where your payments are not treated as royalties, for example if Mixmi determines you are billing as a BIR-registered business or professional, creditable Expanded Withholding Tax applies instead. The default rate is 10%, reduced to 5% once you submit a valid BIR-stamped sworn declaration of gross receipts and Mixmi approves it, available under BIR RR 11-2018 where your total annual gross income is ₱3,000,000 or below. Creditable tax is credited against your income tax and we certify it on BIR Form 2307 so you can claim it.
The rate and regime applied to each withdrawal are shown to you before you confirm it, and are fixed at that moment: a later change to Mixmi's rates or to your regime does not alter withdrawals already requested. Mixmi will give reasonable advance notice before changing the regime that applies to you by default. You are responsible for providing an accurate Tax Identification Number (TIN), for keeping your registered taxpayer name and address current, and for your own tax filings. Nothing in this section is tax advice.
When we withhold.Withholding happens when your earnings are released from Pending into your Ready-to-Withdraw balance, not when you request a payout. Your Ready-to-Withdraw balance is therefore already net of tax: the amount you see is the amount you receive, less only the flat transfer fee. Because we must report the withholding against your TIN, earnings stay in Pending until you have added one, and are released automatically once you do. The rate and regime are fixed at the moment of release and are shown on the earning; a later change to Mixmi's rates or to your regime does not alter earnings already released.
Earnings are recorded in PHP and represent amounts owed by Mixmi to you as the counterparty for the underlying artwork sale. They are not funds held in trust, electronic money, or stored value, and they do not earn interest. Your earnings ledger is not a wallet or payment account: it is credited only by Mixmi from your own artwork sales and is paid out only to you. You cannot load, deposit, transfer, or spend the balance, and it cannot be used to pay any third party. The earnings ledger is append-only; corrections are made by appending reversing entries, never by modifying past records.
If a buyer is refunded or successfully chargebacks an order before the funds reach your Ready-to-Withdraw balance, the corresponding earning is reversed at no impact to amounts you have already withdrawn. If the funds were already withdrawn before a chargeback, Mixmi may recover the amount from future earnings; we will always notify you before any reversal. Mixmi reserves the right to withhold a payout if fraudulent activity is suspected, pending investigation.
Mixmi takes fraud and platform abuse seriously. We reserve the right to investigate any account, order, or refund claim that displays signs of fraudulent or abusive behavior. The following framework governs how abuse is detected and acted upon:
| Trigger | Action |
|---|---|
| 3 or more refund claims within 90 days | Flagged for review |
| Confirmed fraud (fake photos, false delivery claim proven by POD) | Immediate permanent ban |
| Chargeback filed while refund is being processed | Immediate permanent ban |
| Coordinated abuse (multiple linked accounts) | All linked accounts permanently banned |
| First-time suspected abuse (unconfirmed) | Refund hold + written warning |
Permanently banned accounts will be notified via email within 3 business days of the ban being imposed. Banned users have a one-time right to appeal within 15 days of receiving the ban notice by contacting support@mixmi.co with supporting evidence. Mixmi's decision on appeal is final. Any available wallet balance held by a banned licensor account will be paid out within 30 days after the resolution of any pending disputes, unless the balance itself is subject to fraud investigation.
Mixmi reserves the right to permanently ban all accounts determined to be linked through shared devices, IP addresses, payment methods, or shipping addresses where coordinated abuse is suspected. Linked accounts are treated as a single actor for the purposes of abuse detection and enforcement.
Filing a chargeback or payment dispute with a bank, card issuer, or e-wallet provider while a refund claim is actively being processed by Mixmi is considered bad-faith conduct and will result in immediate permanent account suspension. Mixmi reserves the right to submit evidence of the active refund process to the payment provider to contest the chargeback.
Mixmi is provided "as is" and we do not guarantee that the Platform will be uninterrupted, error-free, or fit for any particular purpose. We will make reasonable efforts to maintain availability and performance, but we cannot warrant against technical failures beyond our control.
To the fullest extent permitted by Philippine law, Mixmi shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of sales, loss of data, or business interruption, arising from your use of or inability to use the Platform.
Where liability cannot be fully excluded under applicable law, our total liability to any licensor or buyer shall not exceed the greater of:
whichever is higher.
Mixmi is the seller and producer of record for the physical products sold through the Platform. We collect payment from buyers, arrange production through our print partners, and are the merchant of record for each transaction. Creators — the independent artists and designers whose work is sold on the Platform, each a "licensor" — license their artwork to Mixmi for reproduction on those products; they do not sell directly to buyers. Each licensor represents and warrants that they own or hold all rights necessary to license their uploaded artwork and that it does not infringe any third party's rights, and remains responsible for its originality and legality and indemnifies Mixmi accordingly, as set out in Section 3. Mixmi does not pre-screen artwork for ownership or infringement; we rely on these representations and act on valid complaints under our IP & Copyright Policy.
Mixmi coordinates print fulfillment through third-party print partners. While we take reasonable steps to ensure print quality, minor variations in color, texture, or finish between digital previews and physical products are inherent to the printing process and do not constitute defects. Mixmi will replace or refund orders where the printed product materially differs from the approved artwork due to a fulfillment error on our part, consistent with Section 7 of these Terms.
Notwithstanding the above, nothing in this clause limits Mixmi's liability for fraud, gross negligence, or any liability that cannot be excluded under the Philippine Consumer Act (RA 7394) or the Electronic Commerce Act (RA 8792).
We may update these Terms of Service at any time. Material changes will be communicated via email or a notice on the Platform. Continued use of Mixmi after changes constitutes acceptance of the updated terms.
Most issues are resolved fastest by raising them with us directly, so we ask that you use the steps below in order before escalating.
Nothing in this section limits your rights as a consumer under Philippine law. If a matter remains unresolved, you may bring a complaint before the Department of Trade and Industry or another appropriate Philippine government agency. Governing law and venue are set out in Section 1.
