1. Agreement to Terms

By accessing or using Mixmi ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. Mixmi is operated in the Philippines and these terms are governed by Philippine law.

2. Account Responsibilities

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to create a vendor account. Buyers under 18 may use the Platform with parental consent.
  • One person may hold one buyer account and one vendor account. Multiple accounts for the purpose of manipulating the Platform are prohibited.
  • We reserve the right to suspend or terminate accounts that violate these terms.

3. Vendor Obligations

  • Original work only. You must own or have full commercial rights to every artwork you upload. Uploading stolen, copied, or unlicensed artwork is strictly prohibited and will result in immediate account termination.
  • No AI-generated artwork. Mixmi does not permit the sale of artwork created primarily by generative AI tools (including but not limited to Midjourney, DALL-E, Stable Diffusion, or similar). Artwork must be substantially hand-created by the vendor. AI may be used as a minor assistive tool (e.g., background removal, upscaling) but must not generate the core creative content. Violations will result in artwork removal and potential account suspension.
  • Pricing. You set the price for your artwork with a minimum of ₱100 PHP. The Mix & Save pricing engine ensures you always earn at least 50% of your set price (floor price) per sale.
  • Content standards. Artwork must not contain hate speech, explicit sexual content, violence, or content that infringes on trademarks or copyrights. Community members can report artwork, and flagged content is reviewed by our team.
  • Payout information. You must provide valid payout account details via Xendit before requesting your first withdrawal. You are responsible for the accuracy of your payout information.
  • Indemnification. You agree to defend, indemnify, and hold harmless Mixmi, its officers, employees, and partners from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or related to: (a) your uploaded artwork infringing a third party's intellectual property rights; (b) your breach of any representation or warranty in these Terms; (c) any claim that your artwork contains defamatory, offensive, or unlawful content; or (d) your violation of any applicable law in connection with your use of the Platform. Mixmi reserves the right to assume exclusive control of any matter subject to indemnification, at your expense. You may not settle any claim without Mixmi's prior written consent.

4. Buyer Obligations

  • You agree to pay the full listed price including shipping at checkout. Payment gateway fees (e.g., GCash, Maya, card processing) are absorbed by Mixmi and are not added to your total.
  • You must provide an accurate shipping address. Mixmi is not responsible for orders shipped to an incorrect address provided by the buyer.
  • Compositions you create are private until you purchase them. After purchase and fulfillment, you may publish them to your collection.
  • Intellectual property. Physical products purchased through Mixmi are for personal use or resale of the physical item only. Buyers do not acquire any intellectual property rights, licenses, or permissions to reproduce, print, modify, or commercially exploit the underlying artwork in any form. Unauthorized reproduction of vendor artwork outside the Platform is a violation of these Terms and applicable Philippine IP law.
  • Refund process. Buyers agree to submit all refund or replacement requests through Mixmi's official support process at support@mixmi.co before initiating any dispute, chargeback, or reversal with their bank, card issuer, or e-wallet provider. Filing a chargeback while a refund request is actively being processed by Mixmi is considered a violation of these Terms and may result in permanent account suspension.

5. Pricing and Earnings

Setting your price

You set the price for each artwork you upload. The minimum set price is ₱100. There is no maximum. Each artwork's floor price is 50% of its set price — this is the lowest amount that artwork will contribute to any sale's art pool. You can change your set price for future sales at any time. Pending orders are unaffected by price changes; the price snapshot at the time of order is what applies.

Solo product sales

When a buyer purchases a product with only one artwork, you earn your full set price minus Mixmi's platform fee.

Platform fee:

  • 25% when the sale originates from Mixmi's Discover page
  • 20% when the sale originates from your artist profile or your direct shop link

The platform fee is calculated on the art pool only. Production cost, shipping, and payment processing are handled separately and are not deducted from your earnings.

Multi-artwork product sales (Mix & Save)

When a buyer composes a product using two or more artworks, Mixmi's Mix & Save pricing engine applies. The engine adjusts the total art pool so buyers pay a fair price for compositional products instead of the sum of every individual set price, while protecting every artwork by its own floor (50% of its set price).

The Mix & Save engine works as follows:

  1. The highest-priced artwork on the product anchors the art pool, starting at its full set price.
  2. Each additional artwork joins the pool at its own floor (50% of its set price).
  3. The anchor's contribution decreases by the floor amount of each additional artwork. The anchor stays as high as the math allows — it only settles at its own floor if cumulative deductions would otherwise push it below floor.
  4. Once the anchor is at its floor, every additional artwork is added at its own floor with no further deduction.
  5. No artwork ever pays out below its own floor.

The platform fee (25% or 20% depending on origin) is then applied to the adjusted art pool. Each artist pays a share of the fee proportional to their artwork's contribution to the pool. Each artist's earnings = (their artwork's contribution to the pool) − (their share of the platform fee).

How earnings are distributed across modes

  • Own-only mode: All artworks on the product are yours. You earn the full art pool minus the full platform fee.
  • Open mode (default): Artworks come from multiple artists. Each artist earns their artwork's contribution to the pool minus their proportional share of the platform fee.

Mode selection

Every artwork you upload is set to Open mode by default. You can switch any artwork to Own-only mode at any time from your artwork dashboard. Mode changes apply to future orders only.

Worked examples (all Discover origin, 25% platform fee)

  • Solo sale: Your artwork at ₱500. Art pool ₱500. Your platform fee ₱125. You earn ₱375.
  • Two artworks, your ₱500 + another artist's ₱200 (cross-artist): Anchor (you) absorbs B's floor of ₱100. Pool: you ₱400 + them ₱100 = ₱500. Total fee ₱125. Your share ₱100, theirs ₱25. You earn ₱300, they earn ₱75.
  • Two artworks, both yours at ₱500 (own-only or open, both your work): Anchor absorbs B's floor of ₱250. Pool: ₱250 + ₱250 = ₱500. Total fee ₱125. You earn ₱375 (full pool minus full fee).
  • Premium artwork in a large composite: Your ₱2000 + 3 artworks at ₱200, ₱400, ₱600 (cross-artist). Anchor absorbs ₱100 + ₱200 + ₱300 = ₱600 in deductions. Pool: ₱2000. Your contribution ₱1400. Your share of fee ₱350. You earn ₱1050.
  • Anchor reaches floor: Your ₱500 + your ₱200 + your ₱300 + your ₱400 (own-only). Anchor absorbs ₱100 + ₱150 = ₱250, hits floor. D adds ₱200 directly. Pool: ₱700. Total fee ₱175. You earn ₱525.

Settlement and payouts

When a buyer pays for an order, Mixmi records what we owe you as a commercial payable in your earnings ledger. Your earnings move through two states: Pending, while the order is being fulfilled, and Ready to Withdraw, once the order is fulfilled (for prepaid orders) or once we have collected the cash from our fulfillment partner (for cash-on-delivery orders). See §8 Earnings & Payouts for full mechanics.

A payment gateway fee of 3% is absorbed by Mixmi and is not deducted from your earnings.

Refunds and chargebacks

If a buyer is refunded or successfully chargebacks an order before the funds settle, the corresponding earnings are reversed in your wallet at no impact to amounts you've already withdrawn. If the funds were already withdrawn before the chargeback, Mixmi may recover the amount from future earnings. We will always notify you before any reversal.

6. Intellectual Property

  • Vendor ownership. Vendors retain full ownership and copyright of their artwork. By uploading to Mixmi, you grant us a non-exclusive, worldwide license to display, reproduce, and print your artwork on products ordered through the Platform.
  • Platform content. The Mixmi brand, logo, design system, and platform code are owned by Mixmi. You may not copy, modify, or distribute them.
  • DMCA / Takedown. If you believe your intellectual property has been infringed, contact us at legal@mixmi.co or visit our Report Infringement page. We will investigate and remove infringing content within 5 business days.

7. Orders, Fulfillment & Refunds

Orders are fulfilled by our vetted third-party print fulfillment partner. Estimated production time is 3-5 business days, plus shipping. Details of our current fulfillment partner are available upon request at support@mixmi.co.

Delivery confirmation

Our fulfillment partner coordinates proof-of-delivery (POD) photography with the courier at the point of handoff. Buyers are strongly encouraged to photograph or video the unopened package upon delivery before opening. Claims supported by unboxing documentation will be processed faster and with greater accuracy. Mixmi reserves the right to request POD records from the fulfillment partner or courier as part of any refund investigation.

What qualifies for a refund or reprint

  • Wrong item printed (artwork does not match approved composition)
  • Damaged or defective item upon delivery, limited to the specific item(s) confirmed as damaged. Partial damage in a bulk order is not grounds for a full order refund unless 80% or more of items in the order are confirmed defective, in which case a full order refund may be requested at Mixmi's discretion.
  • Missing order not delivered within the estimated timeframe, subject to courier POD verification

What does not qualify for a refund

  • Change of mind after purchase
  • Incorrect size selected by the buyer at checkout
  • Design or color preferences after fulfillment
  • Minor color variations between the digital preview and the printed product. Due to differences between screen displays and physical print output, color shifts of up to 15% from the digital preview are inherent to the printing process and do not constitute a defect.
  • Damage claimed without supporting photo or video evidence of the unopened or opened package

Refund investigation hold

All refund and reprint requests are subject to a mandatory investigation period of 5-7 business days from the date the claim is submitted. During this period, Mixmi will verify the claim with the fulfillment partner and courier records before approving or denying the request. No refund or reprint will be issued prior to the conclusion of the investigation. Mixmi reserves the right to deny claims where evidence of intentional damage, fraud, or abuse is found.

Who absorbs refund costs

Refunds and reprints for confirmed fulfillment errors are absorbed by the Platform. Vendor earnings are not clawed back on fulfilled orders. If an order is cancelled before fulfillment begins, any pending wallet balance is reversed.

8. Earnings & Payouts

When a buyer pays for an artwork that includes your work, Mixmi records what we owe you as a commercial payable in your earnings ledger. Your earnings move through two states: Pending, while the order is being fulfilled, and Ready to Withdraw, once the order is fulfilled (for prepaid orders) or once we have collected the cash from our fulfillment partner (for cash-on-delivery orders). Ready-to-withdraw earnings can be cashed out at any time. There is no minimum.

Pending earnings are not held as a deliberate buffer; they simply track orders that haven't shipped yet. Holding them in Pending until fulfillment protects you from chargebacks or refunds on orders that fail before they leave the warehouse, so that no amount is ever clawed back from your Ready-to-Withdraw balance.

Withdrawals are processed through Xendit to your registered Philippine bank account, GCash, or Maya. A flat payout fee of ₱25 per transaction is deducted at the time of withdrawal to cover the disbursement cost charged by our payment partner; the fee is shown in the withdrawal confirmation before you submit. You may choose manual withdrawals (you initiate each one) or automatic payouts (Mixmi disburses your full available balance, less the fee, at the end of each month). The fee applies to both modes.

Earnings are recorded in PHP and represent amounts owed by Mixmi to you as the counterparty for the underlying artwork sale. They are not funds held in trust, electronic money, or stored value, and they do not earn interest. The earnings ledger is append-only; corrections are made by appending reversing entries, never by modifying past records.

If a buyer is refunded or successfully chargebacks an order before the funds reach your Ready-to-Withdraw balance, the corresponding earning is reversed at no impact to amounts you have already withdrawn. If the funds were already withdrawn before a chargeback, Mixmi may recover the amount from future earnings; we will always notify you before any reversal. Mixmi reserves the right to withhold a payout if fraudulent activity is suspected, pending investigation.

9. Content Moderation

  • Artwork is auto-approved on upload and goes live immediately. Auto-approval does not constitute Mixmi's endorsement or verification of an artwork's originality or IP ownership. Responsibility remains solely with the vendor.
  • Community members can report artwork. Three or more reports flag the artwork for admin review.
  • Our team may deactivate artwork or suspend accounts that violate content standards, intellectual property rights, or the AI-generated artwork policy.
  • Decisions on content removal are at our sole discretion. We will notify the vendor via email when artwork is removed.

10. Fraud & Abuse Prevention

Mixmi takes fraud and platform abuse seriously. We reserve the right to investigate any account, order, or refund claim that displays signs of fraudulent or abusive behavior. The following framework governs how abuse is detected and acted upon:

Permanent ban & appeal

Permanently banned accounts will be notified via email within 3 business days of the ban being imposed. Banned users have a one-time right to appeal within 15 days of receiving the ban notice by contacting support@mixmi.co with supporting evidence. Mixmi's decision on appeal is final. Any available wallet balance held by a banned vendor account will be paid out within 30 days after the resolution of any pending disputes, unless the balance itself is subject to fraud investigation.

Coordinated abuse

Mixmi reserves the right to permanently ban all accounts determined to be linked through shared devices, IP addresses, payment methods, or shipping addresses where coordinated abuse is suspected. Linked accounts are treated as a single actor for the purposes of abuse detection and enforcement.

Chargeback abuse

Filing a chargeback or payment dispute with a bank, card issuer, or e-wallet provider while a refund claim is actively being processed by Mixmi is considered bad-faith conduct and will result in immediate permanent account suspension. Mixmi reserves the right to submit evidence of the active refund process to the payment provider to contest the chargeback.

11. Account Termination

  • You may delete your account at any time from the Settings page.
  • Upon deletion, your profile and artworks are removed within 30 days. Order financial records are retained for 10 years as required by law.
  • Mixmi may terminate accounts that violate these terms, engage in fraud, or upload prohibited content (including AI-generated artwork).
  • Any available wallet balance at the time of termination will be paid out within 30 days, minus any pending disputes.

12. Limitation of Liability

Mixmi is provided "as is" and we do not guarantee that the Platform will be uninterrupted, error-free, or fit for any particular purpose. We will make reasonable efforts to maintain availability and performance, but we cannot warrant against technical failures beyond our control.

To the fullest extent permitted by Philippine law, Mixmi shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of sales, loss of data, or business interruption, arising from your use of or inability to use the Platform.

Where liability cannot be fully excluded under applicable law, our total liability to any vendor or buyer shall not exceed the greater of:

  • the total platform fees or commissions earned by Mixmi from your transactions in the 3 months preceding the claim, or
  • ₱5,000

whichever is higher.

Marketplace role

Mixmi acts as a marketplace platform connecting vendors and buyers. We are not responsible for the quality, accuracy, safety, or legality of vendor-uploaded artwork, product descriptions, or vendor representations. Vendors assume full responsibility for ensuring their content does not infringe third-party intellectual property rights.

Print fulfillment role

Mixmi coordinates print fulfillment through third-party print partners. While we take reasonable steps to ensure print quality, minor variations in color, texture, or finish between digital previews and physical products are inherent to the printing process and do not constitute defects. Mixmi will replace or refund orders where the printed product materially differs from the approved artwork due to a fulfillment error on our part, consistent with Section 7 of these Terms.

Notwithstanding the above, nothing in this clause limits Mixmi's liability for fraud, gross negligence, or any liability that cannot be excluded under the Philippine Consumer Act (RA 7394) or the Electronic Commerce Act (RA 8792).

13. Changes to Terms

We may update these Terms of Service at any time. Material changes will be communicated via email or a notice on the Platform. Continued use of Mixmi after changes constitutes acceptance of the updated terms.
